These Terms of Service ("Terms") govern your use of betterthanspit.com and any purchase from Better Than Spit, LLC ("BTS," "we," "us," or "our"). Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to you.

By visiting the website or purchasing from us, you agree to these Terms and the policies linked within them. If you do not agree, do not use the website or place an order.

1. Eligibility

The website and our products are intended for adults age 18 and older. By using the website or placing an order, you represent that you are at least 18 years old and legally able to enter into these Terms.

2. Lawful store use

You may use the website only for lawful personal shopping. You must not use the website or any product for an unlawful purpose, violate applicable law, transmit malicious code, interfere with website security or operation, scrape or harvest store or customer data, or attempt to gain unauthorized access to any system.

3. Product information and imagery

We make reasonable efforts to keep product descriptions, ingredients, sizes, prices, and availability accurate. Product colors and finishes may appear slightly different depending on your screen, settings, and lighting. Rendered imagery is used only when it reasonably represents the product, and we intend to replace launch imagery with real product photography when available.

We may correct typographical, pricing, description, or availability errors before accepting an order. Information on the website may be updated without notice.

4. Prices, taxes, and availability

All prices are listed in U.S. dollars and may change for future purchases without notice. Taxes and shipping charges are calculated and shown before purchase is completed. Product availability and inventory are not guaranteed until an order is accepted.

5. Order acceptance and refusal

Submitting an order does not guarantee acceptance. BTS may refuse, limit, or cancel an order for reasons including suspected fraud or unauthorized payment, incorrect pricing or product information, inventory errors, shipping restrictions, unusually large quantities, suspected unauthorized resale, or violation of these Terms.

If BTS cancels an order after payment has been collected, the canceled amount will be refunded to the original payment method.

6. Personal use and resale

Products purchased through the BTS online store are intended for personal use unless BTS separately approves a wholesale or authorized-reseller arrangement. You may not purchase products for unauthorized resale.

7. Payment

You agree to provide current, complete, and accurate purchase and payment information. Payment information is processed by Shopify and its payment providers. You represent that you are authorized to use the payment method submitted with your order.

8. Shipping

Shipping destinations, processing times, delivery estimates, rates, address responsibilities, and package-claim procedures are described in our Shipping Policy. Carrier delivery estimates are not guarantees.

9. Cancellations, refunds, and claims

All sales are final except for approved claims involving damaged, leaking, defective, incorrect, or confirmed lost orders. Cancellation and order-change requests are not guaranteed. Full requirements, timing, and available remedies are described in our Refund Policy.

10. Product selection and use

Review the ingredients, directions, and warnings provided with each product and use products only as directed. The website's formula comparisons are for product-selection purposes and are not medical advice.

BTS does not make medical, therapeutic, contraceptive, or compatibility claims beyond factual information printed on the product or packaging. If irritation occurs, discontinue use. Nothing in these Terms limits rights or remedies that cannot legally be limited.

11. Intellectual property

All website content—including the Better Than Spit name, BTS name, logos, tagline, packaging designs, product images, graphics, written copy, and page design—is owned by or licensed to Better Than Spit, LLC and protected by applicable intellectual-property laws.

Without written permission, you may not copy, reproduce, publish, distribute, modify, sell, commercially reuse, or create derivative works from our content, logos, packaging, or product imagery.

12. Third-party tools, services, and links

Parts of the website and checkout are provided through Shopify and other service providers. We may also link to third-party websites or services that we do not control. Your use of a third-party service may be governed by that provider's own terms and privacy practices. BTS is not responsible for third-party content or services to the extent permitted by law.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the website, you acknowledge that your information may be processed by Shopify and other service providers as described there.

14. Feedback and submissions

If you voluntarily send suggestions, ideas, reviews, or other feedback, you grant BTS a nonexclusive, worldwide, royalty-free right to use, reproduce, adapt, publish, and display that feedback for lawful business purposes. You represent that your submission does not violate another person's rights or applicable law. This section does not transfer ownership of your private customer-support messages or personal information.

15. Disclaimer of warranties

Except as expressly stated by BTS or required by law, the website, its content, and the services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, BTS disclaims implied warranties and conditions, including merchantability, fitness for a particular purpose, durability, title, and non-infringement.

We do not warrant that website access will always be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, BTS and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or services, including lost profits, lost revenue, lost savings, loss of data, or replacement costs.

Any permitted limitation applies only to the fullest extent allowed by law. Nothing in these Terms excludes or limits liability, rights, or remedies that cannot legally be excluded or limited.

17. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless BTS and its owners, officers, employees, contractors, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the website, your violation of these Terms, or your violation of another person's rights.

18. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.

19. Waiver

Failure by BTS to enforce a provision of these Terms is not a waiver of that provision or any other right.

20. Termination

We may suspend or terminate access to the website for conduct that violates these Terms or applicable law. Obligations and liabilities incurred before termination, and provisions that by their nature should survive, will continue after termination.

21. Entire agreement

These Terms, together with policies posted on the website, form the agreement between you and BTS regarding the online store and replace prior communications about the same subject. Headings are included for convenience and do not limit the provisions they describe.

22. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without applying conflict-of-law rules. Any court proceeding must be brought in the appropriate state or federal court serving Duval County, Florida, unless applicable law gives you another non-waivable right.

These Terms do not require mandatory arbitration, waive class-action rights, or restrict access to an eligible small-claims process.

23. Changes to these Terms

We may update these Terms by posting a revised version on the website. Changes apply prospectively from the stated update date. Continued use of the website after an update constitutes acceptance to the extent permitted by law.
